De Ethische Code van Australië

1. Inleiding

De Australische schaakbond, Australian Chess Federation (ACF), kent een eigen Ethische Code.

De Code geldt voor iedereen die bij een schaakwedstrijd van de Australische bond is betrokken, zoals spelers, scheidsrechters en organisatoren.

Een bijzonderheid is artikel 1.3.2 waarin geregeld is dat de Code ook geldt voor een schaker met een ACF rating buiten Australië of die op internet speelt, ongeacht of hij al of niet een officiële vertegenwoordiger is van Aus-
tralië. Zo is de Code van toepassing op een Australische schaker met een ACF rating die bijvoorbeeld in Nederland een wedstrijd speelt in de KNSB-competitie, of in de HSB-competitie. Dit heet: het personaliteitsbeginsel.

Het gedrag van betrokkene moet voldoen aan twee beginselen. Het moet in overeenstemming zijn met:
1. de FIDE-regels en toernooireglementen
2. 'de hoogste normen van eerlijk spel en sportiviteit'.
Het gaat zelfs om 'de hoogste normen' van eerlijk spel en sportiviteit.

Het doel van de Code is ervoor te zorgen, voor zover dat mogelijk is, dat het schaakspel dat in Australië wordt gespeeld, en door een Australische speler in het buitenland of op internet, op een sportieve en eerlijke manier wordt gespeeld. De Code geeft voorbeelden van onbehoorlijk bedrag. Het
is geen uitputtende opsomming.

In artikel 3 staan de voorbeelden van onbehoorlijk bedrag.

Behalve de Australische schaakbond kent ook de New South Wales Australia Chess Assosiation (NSWCA) een eigen gedragscode. De NSWCA is een 'af-
filiation' van de Australische schaakbond. Volgens onze begrippen te verge-
lijken met een regionale bond, hoewel het gebied aanzienlijk groter is dan Nederland.

Interessant is de Australische Gedragscode voor Jeugdspelers genoemd in paragraaf 3. Wellicht kunnen jeugdleiders inspiratie opdoen van deze code.

2. Vertaling Australische Gedragscode

Eigen vertaling.


1. Inleiding

1.1 Voor de juiste uitvoering van het schaakspel en die van schaaktoernooi-
en moeten de betrokkenen zich houden aan:
1.1.1 de regels en geldende voorwaarden die van toepassing zijn op het spel en het toernooi; en
1.1.2 de hoogste normen van eerlijk spel en sportiviteit.

1.2 Geschillen die tijdens een partij of een gebeurtenis rijzen moeten worden beslecht volgens de FIDE-regels en andere regels of voorwaarden die van toepassing zijn op het spel of het toernooi.

1.3 Deze Code is van toepassing op:
1.3.1 een persoon die speelt in, of een persoon die organiseert
1.3.1.1 een toernooi waarvan de winnaar in aanmerking komt voor een Aus-
tralische titel als beschreven in het ACF reglement voor ACF Toernooien; of
1.3.1.2 een Grand prix wedstrijd; of
1.3.1.3 elk andere partij of wedstrijd die geleid wordt door de ACF; en
1.3.2 een persoon die een ACF rating heeft en die speelt in een toernooi buiten Australië of op internet, ongeacht of hij al of niet een officiële verte-
genwoordiger is van Australië.

1.4 Het wordt ten zeerste aanbevolen dat aangesloten verenigingen en bon-
den en hun verenigingen de Code voor hun doeleinden overnemen.

1.5 Deze Code moet gelezen worden als ondergeschikt aan de FIDE-regels.


2. Het doel van de Ethische Code

2.1 Het doel van deze Code is ervoor te zorgen, voor zover dat mogelijk is, dat het schaakspel dat in Australië wordt gespeeld, en door een Australische speler in het buitenland of op internet, op een sportieve en eerlijke manier wordt gespeeld.

2.2.1 Artikel 12 en 13 van de FIDE-regels regelen respectievelijk het gedrag van de spelers en de taak van de scheidsrechter. Indien een zaak zich voor-
doet, worden in de eerste plaats deze regels toegepast. Het Voorwoord van de FIDE-regels erkent dat 'de FIDE-regels niet alle mogelijke situaties, die tijdens een partij voorkomen, kunnen dekken. Evenmin kunnen ze alle ad-
ministratieve kwesties regelen.'
2.2.2 Eveneens is het onmogelijk in deze Code elke omstandigheid of norm-
gedrag dat verwacht wordt van spelers, officials en toeschouwers bij een spel of wedstrijd precies te beschrijven of om een lijst op te stellen van alle zaken die een schending van de Code kunnen inhouden en die zouden leiden tot disciplinaire maatregelen.

2.3 De volgende regels van deze Code, hoewel niet uitputtend, leggen op zo'n manier het gedrag vast dat het eenvoudiger wordt het gedrag af te keuren waarmee men te maken heeft.


3. Schendingen van de Ethische Code

3.1 Iemand die een van de volgende handelingen verricht, schendt deze Code.

3.2 Behoudens artikel 12.7 (tegenwoordig: 12.8 PdeG) van de FIDE-regels herhaaldelijk of op ernstige wijze de FIDE-regels schenden of de regels of voorwaarden die van toepassing zijn op een bijzonder schaakevenement.

3.3. Vals spelen, of proberen om vals te spelen, tijdens een wedstrijd of een schaakevenement.

3.4 De uitslag van een wedstrijd of een schaakevenement van te voren af te spreken, of proberen dat te doen.

3.5 Terugtrekken uit een schaakevenement zonder een geldige reden.

3.6 Te kort schieten in het nakomen van algemeen aanvaarde normen van beleefdheid en van schaaketiquette.

3.7 Onbehoorlijk gedrag toepassen dat algemeen onaanvaardbaar is volgens algemeen sociale normen.

3.8 Gewelddadig, bedreigend of ander onbehoorlijk gedrag toepassen tijdens of in verband met een wedstrijd of een schaakevenement.

3.9. Het doen van onrechtvaardige beschuldigingen tegen spelers, officials of sponsors van een schaakevenement.

3.10 Deelnemen aan een schaakevenement onder een valse naam of tijdens een schorsing.

3.11 Uitdrukkelijk tegen een bepaalde persoon tegen wie hij is ingedeeld weigeren te spelen of deze negeren.

3.12 Gedrag vertonen waardoor het aannemelijk is dat de reputatie van het ACF, haar schaakevenementen, organisatoren, deelnemers of sponsors wordt geschonden.

3.13 Als organisator, toernooi directeur, scheidsrechter of andere official van een schaakevenement
3.13.1 te kort schieten zijn of haar taken in verband met dat schaakevene-
ment op een onpartijdige en verantwoordelijke wijze te tonen, of
3.13.2 te kort schieten in het nemen van de noodzakelijke maatregelen om het juiste gedrag in acht te nemen voor het schaakevenement, of de wed-strijden van het schaakevenement volgens de FIDE-regels en de toernooi-
regels of de voorwaarden.

4. Klachten en Straffen

4.1 Alle klachten over het gedrag van spelers tijdens een schaakevenement moeten gericht worden aan de scheidsrechter van het evenement die een passende straf kan opleggen.

4.2 Elke speler die, of in zijn hoedanigheid van speler of die van toeschou-
wer, zich gedraagt in strijd met paragraaf 3.5, 3.6, 3.7 of 3.8 kan voor een of meer wedstrijden worden gestraft door het verlies van de partij afhanke-
lijk van de ernst van de overtreding.

4.3 Andere klachten of rapportages van een vermeende schending van deze Code kunnen gericht worden aan de Raad van de Australische Schaakbond die de zaak zal bespreken en beslissen.

4.4 Elke speler of toeschouwer die zich gedraagt in strijd met deze Code kan voor de duur van een passende periode voor wedstrijden of schaakevene-
menten worden uitgesloten.

4.5 Elke scheidsrechter of andere functionaris die handelt in strijd met deze Code kan voor de duur van een passende periode van het uitoefenen van zijn functie in of verband met een schaakevenement waarop deze Code van toepassing is, worden ontheven.

4.6 Een straf onder paragraaf 4.3, 4.4 of 4.5 kan slechts opgelegd worden door de Raad van de Australische Schaakbond na een degelijk onderzoek overeenkomstig de beginselen van een eerlijk proces waarin iedereen die beschuldigd wordt van het overtreden van de Code deze beschuldiging kenbaar is gemaakt en hem de gelegenheid is gegeven weerwoord op de beschuldiging te geven in zijn zaak.


5. Beroep

5.1 Een persoon die gestraft wordt op grond van artikel 4.1 of 4.2 heeft het recht van beroep zoals beschreven in de regels of voorwaarden van het schaakevenement waar de gebeurtenis zich heeft voorgedaan.

5.2 Een persoon die gestraft wordt op grond van artikel 4.3, 4.4 of 4.5 kan binnen zeven dagen na bekendmaking daarvan beroep aantekenen.

5.3 Het beroepschrift, dat de gronden daarvan moet bevatten, gaat verge-
zeld met het betalen van $ 50 griffierecht dat terugbetaald wordt indien het beroep gegrond is.

5.4 Het beroep wordt getoetst aan de vraag of de beslissing een inhoudelijke fout bevat of een weglating in de beslissing waardoor de klager is geschaad.

5.5 De Australische Schaakbond zal een persoon benoemen die genoemd wordt als de ACF Tribunaal Convenor. De convenor (d.i. een bemiddelaar, mediator, PdeG) is of een erelid van de Bond, of een oud-president van de Bond.

5.6 De ACF Tribunaal Convenor zal twee andere personen benoemen, die elk of een erelid of een oud-president of oud-plaatsvervangend president zijn om gezamenlijk een Commissie van Beroep te vormen die bestaat uit drie personen.

5.7 De Commissie van Beroep zal zoveel informatie onderzoeken als het passend vindt en zijn beslissing is definitief.

5.8 De Commissie van Beroep kan beslissen dat de beslissing waartegen beroep is aangetekend:
5.8.1 in stand blijft; of
5.8.2 wordt vernietigd; of
5.8.3 wordt gewijzigd.


6. Richtlijnen voor de toepassing van deze Code

6.1 Een ieder wordt geacht de FIDE-regels te kennen, en elke andere regels of voorwaarden die van toepassing zijn op een schaakevenement waar hij een speler, een toeschouwer of een official is en van de bepalingen van deze Code.

6.2 Het volgende commentaar wordt gegeven als richtlijn om behulpzaam te zijn bij de uitleg van de FIDE-regels of van deze Code.

6.3 Artikel 6.13b van de FIDE-regels geeft een speler toestemming de klok-
ken stop te zetten om de bijstand in te roepen van de scheidsrechter. Als voorbeeld wordt gegeven het geval waarin een speler een pion promoveert maar het vereiste stuk niet aanwezig is. Een ander duidelijk voorbeeld is dat waarin een speler op grond van de FIDE-regels een beslissing van de scheidsrechter wenst over een geval dat tijdens het spel zich voordoet.

6.4 Artikel 12.5 (tegenwoordig 12.6 pdg) van de FIDE-regels verbiedt de tegenstander op welke wijze dan ook, af te leiden of te hinderen. Als voor-
beeld is gegeven onredelijke claims of onredelijke remise aanbiedingen.
Een ander gedrag dat beschouwd mag worden onder het verbod te vallen is het overdreven rechtzetten van stukken op grond van artikel 4.2, het voort-
durend slordig plaatsen van de stukken, praten binnen de gehoorsafstand van de tegenstander, onredelijke lichamelijke handelingen zoals het indrin-
gend de tegenstander aanstaren of overdreven gelaatsuitdrukkingen of ge-
baren maken. Het is niet relevant dat het gedrag in kwestie niet bedoeld was om te af te leiden of te hinderen. Indien het gedrag onvrijwillig is gebeurd, zoals een hik of een medische aanval moet de scheidsrechter de zaak met bijzondere bescheidenheid of diplomatie aanpakken.

6.5 Het is niet toegestaan voor spelers of toeschouwers om in zich zelf of met elkaar binnen de gehoorafstand van de spelers die aan het bord zitten te praten omdat het aannemelijk is dat dit deze spelers stoort. Het gedrag om in een andere taal dan het Engels te spreken moet op elk schaakevene-
ment vermeden worden omdat gemakkelijk gedacht kan worden dat het gaat om een gesprek over het verloop van de wedstrijd wat gedrag verbo-
den is op grond van artikel 13.7.

6.6 Opgemerkt moet worden dat terwijl artikel 9.1a de juiste manier voor-
schrijft op welke wijze remise aan te bieden, is elk andere wijze van remise-
aanbod ook geldig. Echter, een aanbod dat gedaan wordt op een andere manier dan op grond van artikel 9.1a kan leiden tot afleiden of hinderen van de tegenstander en dus strijdig is met artikel 12.5 (tegenwoordig 12.6 PdeG).

6.7 Algemeen aanvaarde normen van beleefdheid en schaak etiquette als genoemd in paragraaf 3.6 hierboven, inclusief het behandelen van de te-
genstander met respect en het tonen van beleefdheid bij het in ontvangst nemen van het opgeven van de tegenstander.

3. Vertaling Australische Gedragscode voor Jeugdspelers

ACF Gedragscode voor Jeugdspelers

(aanvaard 23 september 2002)

1. Jeugdspelers die door de ACF zijn geselecteerd of die zijn aangewezen Australië te vertegenwoordigen voor een schaakevenement kunnen verlangd worden een 'Verklaring van ACF Gedragscode' te tekenen voordat zij aan het schaakevenement deelnemen.

2. Spelers die weigeren de verklaring van de gedragscode te tekenen wordt niet toegestaan te spelen in het schaakevenement.

3. De 'Verklaring Gedragscode' moet als volgt worden getekend:

'ACF Gedragscode Van een speler, of als officiële vertegenwoordiger gese-
lecteerd, of toegestaan als een extra of eigen deelnemer, wordt op elk mo-
ment verwacht een hoge gedragsnorm te tonen en zich op een behoorlijke manier te gedragen als vertegenwoordiger van Australië.

Op elk moment zal het gedrag:
- de veiligheid voor anderen niet in gevaar brengen
- rekening houden met anderen
- inhouden een gepaste houding voor hem zelf, zijn familie en zijn land.

In het bijzonder:
Aanvaarden spelers verantwoordelijkheid voor
- het op tijd zijn voor coaching en partijen
- een attente gast zijn in de plaats waar onderdak wordt verleend
- op elk moment zichzelf gedragen op een niet-onbeleefde manier door zich bewust te zijn van zijn taalgebruik, zijn geluid dat hij maakt, en ander last voor anderen
- het opvolgen van de instructies die de coaches en de teammanager hem geven.

De ouders aanvaarden de verantwoordelijkheid voor
- het steunen van de Australische Schaak Bond bij deze voorwaarden
- het betalen van alle kosten wanneer hun kind verzocht wordt zich terug trekken uit de competitie nadat vergeefs geprobeerd is het gedrag te veran-
deren na een officiële waarschuwing.

Coaches en de teammanager aanvaarden de verantwoordelijkheid voor
- het handhaven van een hoge norm van persoonlijk gedrag
- een speler wiens gedrag aanleiding geeft te zijn in strijd met de gedragscode te waarschuwen en hem uit te leggen wat voor gedrag wel aanvaardbaar is.
- het beleggen van een formele bespreking met de speler (en met de ouder die het kind vergezelt) waar een informele bespreking niet heeft gewerkt.
Bij die bespreking wordt het gedrag besproken en wordt een schriftelijke waarschuwing gegeven aan de speler, waarin staat dat de speler heeft ge-
handeld in strijd met de Code.
- stappen te ondernemen om de speler uit de competitie te verwijderen, in-
dien zijn gedrag na het in ontvangst nemen van een schriftelijke waarschu-
wing ongewijzigd blijft.

We hebben deze gedragscode gelezen, deze overwogen en deze begrepen. Onze handtekeningen hieronder betekenen dat wij de vereisten in de Code aanvaarden.

4. Voor elk jeugd schaakevenement waarvoor de ACF een vertegenwoordi-
ger stuurt kan de ACF een 'team manager' aanwijzen die verantwoordelijk is voor het naleven van de gedragscode en om de ACF op dat evenement te vertegenwoordigen.

5. De team manager zal elke inbreuk op de Gedragscode melden aan de ACF. De ACF kan een straf opleggen aan een speler(s) die inhoudt dat de speler voor een bepaalde periode onbevoegd is Australië te vertegenwoor-
digen.

4. Engelse versie Australische gedragscode

Code Australia
(adopted 6 January 2002)


1. Introduction

1.1 The proper conduct of the game of chess and of chess events depends on everyone involved observing
1.1.1 the rules and conditions currently applying to the game and event; and
1.1.2 the highest standards of fair play and good sportsmanship.

1.2 Disputes arising during a game or event are to be resolved according to the FIDE Laws of Chess and any other rules or conditions then applicable to the game or event.

1.3 This Code applies to -
1.3.1 a person playing in, or organising
1.3.1.1 an event of which the winner is eligible for an Australian title as defined in the ACF By-laws for ACF Tournaments; or
1.3.1.2 a Grand prix event; or
1.3.1.3 any other game or event conducted by or for the ACF; and
1.3.2 a person having an ACF Rating who plays in an event outside Australia or on the internet, whether as an official representative of Australia or not.

1.4 It is strongly recommended that affiliated associations and bodies and their affiliates adopt the Code for their purposes.

1.5 This Code is to be read subject to the FIDE Laws of Chess 2001.


2. The Purpose of the Code of Ethics

2.1 The purpose of this Code is to ensure, as far as practicable, that the ga-
me of chess is played in Australia, and by Australian players overseas or on the internet, in a sporting and fair manner.

2.2 1 Articles 12 and 13 of the FIDE Laws of Chess 2001 respectively deal with the conduct of players and the role of the arbiter. Those provisions are the primary authority on the matters with which they deal. The Preface to the FIDE Laws recognises that "the Laws cannot cover all possible situations that may arise during a game nor can they regulate all administrative ques-
tions".
2.2.2 Likewise, it is impossible in this Code to define exactly each circum-
stance or standard of conduct expected of players, officials and spectators involved in a game or event or to list everything that would amount to a breach of this Code and lead to disciplinary action. Persons otherwise un-
certain of the conduct expected of them should contact the arbiter or orga-
nisers of the event.

2.3 The following provisions of this Code, while not exhaustive, identify conduct that is of such a character as to attract censure and the manner in which it may be dealt with.


3. Breaches of the Code of Ethics

3.1 This Code is breached by a person who commits any of the following acts.

3.2 Subject to Article 12.7 of the FIDE Laws of Chess 2001, repeatedly or grossly violating the FIDE Laws of Chess or the rules or conditions applicable to a particular event.

3.3 Cheating, or attempting to cheat, during a game or event.

3.4 Pre-arranging, or attempting to pre-arrange, the result of a game or event.

3.5 Withdrawing from an event without valid reason.

3.6 Failing to comply with normally accepted standards of courtesy and chess etiquette.

3.7 Engaging in misbehaviour of a personal nature that is generally unaccep-
table by normal social standards.

3.8 Engaging in violent, threatening or other unseemly behaviour during, or in connexion with, a game or event.

3.9 Making unjustified accusations towards other players, officials or spon-
sors of an event.

3.10 Participating in an event under a false name or while under suspension.

3.11 Persistently refusing or neglecting to play against a specific person against whom he is paired.

3.12 Engaging in conduct likely to injure the reputation of the ACF, its events, organisers, participants or sponsors.

3.13 Being an organiser, tournament director, arbiter or other official of an event
3.13.1 failing to perform his or her functions in relation to that event in an impartial and responsible manner; or
3.13.2 failing to take necessary steps to ensure the proper conduct of the event, or games in the event, according to the FIDE Laws of Chess and the tournament rules or conditions.

4. Complaints and Penalties

4.1 All complaints concerning the behaviour of players during an event must be made to an arbiter of the event who may impose an appropriate penalty.

4.2 Any player who, either in the capacity of player or spectator, engages in behaviour in contravention of paragraphs 3.5, 3.6, 3.7 or 3.8 may be forfei-
ted one or more games depending on the severity of the offence.

4.3 Other complaints or reports of an alleged breach of this Code may be made to the ACF Council which shall consider and decide the matter.

4.4 Any player or spectator acting in contravention of this Code can be ex-
cluded from games or events to which it applies for an appropriate period.

4.5 Any arbiter or other official acting in contravention of this Code can be excluded from performing the functions of arbiter or official in, or in relation to, any event to which this Code applies for an appropriate period.

4.6 A penalty under paragraph 4.3, 4.4 or 4.5 shall be imposed only by the ACF Council after proper inquiry in accordance with the principles of proce-
dural fairness in which anyone alleged to have breached the Code is told of the allegation against them and is given the opportunity to present their case in reply to the allegation.


5. Appeals

5.1 A person penalised under by-law 4.1 or 4.2 has such right of appeal (if any) as is conferred by the rules or conditions governing the conduct of the event.

5.2 A person penalised under by-law 4.3, 4.4 or 4.5 may appeal the decision within 7 days of being notified of it.

5.3 Appeals, stating the grounds thereof, shall be accompanied by a $50 ap-
peal fee which shall be refunded if the appeal is upheld.

5.4 Appeals shall be on the basis that there was a material error or omission in the making of the decision that has disadvantaged the applicant.

5.5 The ACF shall appoint a person known as the ACF Appeals Tribunal Con-
venor (ATC) who shall be either an ACF Honorary Life Member or a former ACF President.

5.6 The ATC shall appoint two other persons, each being either an ACF Ho-
norary Life Member or former ACF President or Deputy President to form a three person tribunal (the Appeals Tribunal) with the ATC.

5.7 The Appeals Tribunal shall seek and consider such information as it con-
siders appropriate and its decision shall be final.

5.8 The Appeals Tribunal may decide that the decision appealed from -
5.8.1 stands; or
5.8.2 is revoked; or
5.8.3 is varied as decided by the Appeals Tribunal.


6. Guidelines for the Application of this Code

6.1 A person is assumed to be aware of the FIDE Laws of Chess, any other rules or conditions applicable to an event in which he is a player, spectator or official and of the provisions of this Code.

6.2 The following observations are made as guidelines to assist in the inter-
pretation of the Laws of Chess and of this Code.

6.3 Art.6.13b of the FIDE Laws of Chess 2001 permits a player to stop the clock in order to seek the arbiter's assistance. An example is given of the case in which a player promotes a pawn but the required piece is not avai-
lable. Another obvious instance is where a player seeks a ruling from the arbiter on a matter arising under the Laws in the course of play.

6.4 Art.12.5 of the FIDE Laws of Chess 2001 forbids the distraction or anno-
ying of the opponent in any manner whatsoever. One example is given, na-
mely, unreasonable claims or offers of a draw. Other conduct that may be regarded as within the prohibition includes excessive adjustment of pieces under Art 4.2, persistent (voortdurend) sloppy (slordig) placement (plaatsen) of pieces, talking within the hearing (gehoorsafstand) of the opponent, un-
reasonable physical action such as staring intently at the opponent or using exaggerated facial expressions or gestures. It is irrelevant that the conduct in question was not intended to distract or annoy. If the conduct is involun-
tary, such an an attack of hiccups or a fit (aanval, medisch) the matter should be handled by the arbiter with particular discretion and diplomacy.

6.5 It is not permissible for players or spectators to talk either to themselves or each other within the hearing of players who are seated at the board as such conduct is likely to disturb those players. The conduct of conversations in a language other than English should be avoided in any event as it may more readily be thought to be a discussion about a game in progress such conduct being forbidden by Art. 13.7.

6.6 It should be noted that, while Art.9.1a prescribes the correct way to offer a draw, any other draw offer is also valid. However an offer made otherwise than in accordance with Art. 9.1a may amount to distraction or annoyance of the opponent and so infringe Art. 12.5.

6.7 Normally accepted standards of courtesy and chess etiquette referred to in para. 3.6, above, include treating the opponent with respect and resigning (zich onderwerpen aan, berusten in), or receiving the opponent's resigna-
tion, with good grace.

1. Junior players who are selected or nominated by the ACF to represent Australia in any junior event may be required by the ACF to sign an "ACF Code of Conduct Agreement" prior to their participation in the event.

2. Players who decline to sign the code of conduct agreement will not be permitted to play in the event.

3. The "Code of Conduct Agreement" to be signed is as follows:

"ACF CODE OF CONDUCT
A player, whether selected as an official representative, or approved as an extra or private participant is expected at all times to exhibit a high standard of behaviour and to conduct themselves in a manner befitting a representa-
tive of Australia.

Behaviour at all times will be
- Safe for all concerned
- Considerate of others
- A fine reflexion on themselves, their family and their country.

Specifically:
- Players accept responsibility for
- Being on time for coaching and games
- Being a considerate guest in the accommodation
- Conducting themselves at all times in an inoffensive manner being aware of language, noise level, and any other imposition on others
- Following instructions given by the Coaches and the Team Manager.

Parents accept responsibility for
- Supporting the Australian Chess Federation Inc. in these requirements
- Paying all costs if their child is requested to withdraw from the competition after failing to modify their behaviour after an official warning.

Coaches and the Team Manager accept responsibility for
- Maintaining a high standard of personal behaviour
- Counselling a player whose behaviour is starting to be in breach of the code of conduct and detailing what behaviour is acceptable.
- Arranging a formal meeting with the player (and parent if accompanied), where informal counselling has not worked. At the meeting the behaviourwould be discussed and a written warning given to the player, that the player is in breach of the code.
- Arranging the player's withdrawal from the competition, should their behaviour remain unmodified after receipt of the written warning.

We have read, considered and understood this code of conduct. Our signa-
tures below indicate our agreement to abide by the Code's requirements.

4. For each junior event to which the ACF sends a representative the ACF may appoint a "Team Manager" who shall be responsible for enforcing the code of conduct and for representing the ACF at the event.

5. The Team Manager shall report any breaches of the Code of Conduct to the ACF. The ACF may impose a penalty upon the player(s) concerned in-
cluding ruling them ineligible to represent Australia for a specified period of time.

6. Code of ethics NSWCA

Preamble

1. The purpose of the rules and procedures set forth in this Code of Ethics is to provide articulated and ethical standards to which the conduct of players, tournament directors, sponsors, and other individuals and entities participa-
ting in or otherwise connected with tournaments, events, or other activities sponsored by the NSWCA Inc and/or its affiliates is to be conformed; to pro-
vide specified sanctions for conduct which does not conform to such stan-
dards; and to provide the procedures by which alleged violations are to be investigated and, if necessary, the appropriate sanctions to be imposed.

2. The standards, sanctions,and procedures set forth in this Code of Ethics are not equivalent to criminal laws and procedures inasmuch as they do not concern personal liberty or property rights. Rather, this Code of Ethics is concerned with the rights and privileges of membership of the NSWCA Inc, including, but not limited to, the privilege of participating in tournaments, events, or other activities as a member of the NSWCA Inc.

3. The standards, sanctions, and procedures set forth in this Code of Ethics shall apply only to (a) actions and behaviour that occur in connection with tournaments, events, or other activities sponsored by the NSWCA Inc or its affiliates; or (b) individuals or entities who misrepresent the nature or extent of their association with the NSWCA Inc or its affiliates.

4. By applying for such membership, each member of the NSWCA Inc agrees to be bound by this Code of Ethics.


Standard of Conduct

5. The actions and behaviour of players, DOPs, sponsors, and other indivi-
duals and entities participating in or otherwise connected with tournaments, events, or other activities sponsored by the NSWCA Inc and/or its affiliates shall in general, be in accordance with the spirit of fair play and good sports-
manship, which the NSWCA Inc and its affiliates, sponsors, and members have a right to expect from such participants, as illustrated by the examples below.

6. The following list does not purport to be a complete itemization of all ac-
tions and behaviour that are considered unethical:
a. Repeated or gross violation of chess proprieties or tournament regulations;
b. Accusations of unethical conduct at a NSWCA Inc sanctioned event, unless made in private to the DOP or other official;
c. Playing in a NSWCA Inc game or tournament when under suspension;
d. Betting on the results of any NSWCA Inc sponsored game or tournament;
e. Repeated or gross anti-social behaviour at the site of a NSWCA Inc sponsored game or tournament;
f. Non-payment of any justified sums owed to the NSWCA Inc or any of its affiliates;
g. Influencing or attempting to influence an entrant to withdraw from any event sponsored by the NSWCA Inc or any of its affiliates;
h. Any actions which bring disrepute on the game of chess.


Procedures

7. Any member, sponsor, affiliate, or official of the NSWCA Inc may initiate procedures under this Code of Ethics. In the case of each alleged violation, the following steps shall occur:
a. A factual enquiry shall be made by the Disciplinary Committee as appoin-
ted by the Council of the NSWCA Inc, assisted as necessary by members of the Council;
b. Appropriate sanctions, if any, shall be imposed by the Disciplinary Com-
mittee (excepting that, in the case of suspensions and expulsions, Article 7 of the NSWCA Inc Constitution is to be applied);
c. Such sanctions shall be deemed final, unless appealed to the Council by the person or persons against whom sanctions have been imposed or upon the initiative of a member of the Council;
d. Upon appeal, a review of the facts and the appropriateness of the sanc-
tions shall be undertaken by the full Council;
e. The sanctions shall be either continued, modified, or revoked.

8. In the case of any factual enquiry pursuant to step a. and, if appropriate, step d. above, the member challenged shall: receive notice of the date, ti-
me, and place of hearing; be furnished in writing of a description of the alle-
ged violation; have the right to produce evidence on his behalf and to be present when any evidence is produced against him; and have the right to be present during the entire hearing.


Sanctions

9. In the case of every sanction that results in suspension or expulsion, a member may not participate in any NSWCA Inc sponsored tournament, event, or activity, including but not limited to:
a. Acting as non-playing captain.
b. Kibitzing any game or event.
c. Being physically present at the site of a tournament.
d. Participating in the corporate or business affairs of the NSWCA Inc or any affiliated organization.

10. Paragraphs 11 to 16 set forth suggested sanctions that may be imposed by appropriate disciplinary bodies. The disciplinary body imposing the sanc-
tion may choose to issue a lesser or greater sanction than those set forth herein; likewise, it may vary, combine, or impose sanctions not set forth below.

11. Reprimand

A determination that a member has committed an offense warranting disci-
pline becomes a matter of record, but no further sanction is imposed at the time. A reprimand automatically carries a probation of at least three months; if the member is adjudged guilty of another offense during that period, he is then liable to further sanctions for both offenses.


12. Censure

A determination that a member has committed a serious offense warranting discipline becomes a matter of record, but no further sanction is imposed at the time. Censure carries a probationary period of at least one year; if the member is adjudged guilty of another offense during that period, he is liable to further sanction for both offenses.


13. Suspended Sentence with Probation

A determination is made that a member has committed an offense warran-
ting discipline. When the discipline is imposed and execution thereof suspen-
ded, such suspension shall include probation for at least six months longer than the discipline imposed. If a member is adjudged guilty of another of-
fense during the period of probation, unless otherwise decreed, the original discipline shall be added to such discipline as may be imposed for the new offense.


14. Suspension

Suspension is a determination that a member has committed an offense warranting abrogation, for a specified period of time, of all membership rights and privileges.


15. Expulsion

Expulsion is a determination that a member has committed an offense war-
ranting the permanent abrogation of all membership rights and privileges, including but not limited to those set forth in paragraph 9 above. An expelled member may be re-admitted to membership only at a General Meeting of the NSWCA Inc (Ref. NSWCA Inc Constitution Article 7). No application for reinstatement may be considered before two years from the date of expul-
sion.


16. Exclusion from Events

This is a more selective determination that a member has committed an offense warranting abrogation of the member's rights to play in certain specified events.


17. The effective date of a sanction imposed on a judged member shall be that date named by the Committee in its determination or, failing that, five days after oral or written notification of such sanction to the judged member.

18. The Secretary of the NSWCA Inc shall be advised, in writing, of each such notice, and such advice shall declare the date upon which the sanction became effective. The Secretary shall in turn report each such sanction to the Council of the NSWCA Inc.
